Dwyane Wade’s ex-wife Siohvaughn Funches is not done with her high school sweetheart just yet.

Three years after finalizing their divorce settlement, Funches is pushing to have the settlement re-opened in light of Wade’s new $47 million contract.

Funches is suing her former divorce lawyer, Brian Hurst, for malpractice, according to Kim Janssen of the Chicago Tribune. She claims that Hurst agreed to the $5 million-plus settlement without her knowledge. The Tribune also says Funches is seeking a piece of Wade’s new basketball earnings.

On Friday, Judge Martin Agran threw out the lawsuit, but proposed that she file an amended lawsuit which her new laywer Thomas Gooch says she will “absolutely” take.

The Sun-Sentinel reached out to Hurst, who says he kept her in the loop and all items were agreed upon by both sides. However, in an excerpt from a Chicago Sun-Times article may suggest otherwise.

Brian Hurst, an attorney for Funches-Wade, argued that his client never fully agreed to all the provisions in the settlement, including the “non-disparage” provision. But Cook County Circuit Court Judge John Thomas Carr decided both parties did agree on the deal and he found the settlement valid, effectively ending a six-year divorce proceeding that has drawn national attention.

Wade and Funches settled in 2013 despite divorcing three years earlier and splitting in 2007. The two have two sons together. Wade has since moved on and married Gabrielle Union.
